3) Data flows and technical description

Map where data travels: user device → vendor API → model training / inference → results storage. Risk increases at every external boundary.

Key questions:

  • Is user input logged? For how long? Is it used to improve the model?

  • Bring Your Own Key (BYOK)

  • Prompt redaction and context minimization

  • No DPA or vague contractual language about data ownership and deletion timelines.
  • Vendor cannot produce a data flow diagram or refuses to show where data is stored geographically.
  • Telemetry captures user identifiers tied to prompts.
  • No SOC 2/ISO attestation and no willingness to undergo an enterprise audit.
  • Vendor terms assert broad IP ownership over generated content in conflict with your requirements.

In our procurement runs, vendors fixed gaps, narrowed deployments (on‑device/private cloud), or were removed from consideration when flagged.

Realistic mitigations that actually work in practice

Layered controls are what work. A single mitigation rarely eliminates all risk. Combinations that proved effective in my evaluations:

  • BYOK + limited retention + opt-out from training: prevents vendor model updates and restricts decryption without your key.
  • On-device inference for high-sensitivity briefs + cloud features for low-sensitivity ideation: keeps critical data local while preserving productivity.
